Welcome to Posizio, a vehicle telematics platform owned and operated by Futurkloud SRL, a Italy-registered company. By creating an account and accessing or using Posizio, you agree to comply with and be bound by the following Terms of Service ("Terms"). If you do not agree with these Terms, do not use the platform.
1. Definitions
"Posizio" refers to the telematics platform and services provided by Futurkloud SRL and its authorized affiliates and resellers.
"User" or "You" means any individual or entity creating an account, accessing, or using Trazet.
"Account" means a registered user profile created to access Trazet services.
"Assets" means any vehicle, device, object, or entity added to the platform for monitoring.
"Content" includes all data, reports, analytics, or other information generated or uploaded via the platform.
2. Account Registration and Responsibility
You must be at least 18 years old or of legal age in your jurisdiction to create an account.
You agree to provide accurate and complete information when registering and to keep your information updated.
You are fully responsible for all activities and content associated with your account and the assets you monitor via Posizio.
Misuse or unauthorized access by individuals under your account will be your responsibility.
3. Global Availability and Local Compliance
Posizio is accessible globally. You are solely responsible for ensuring your use of the platform and any associated hardware complies with local, regional, and international laws, including:
- Data protection and privacy regulations
- Telecommunications and GPS tracking laws
- Import/export laws for connected hardware
4. License and Permitted Use
Futurkloud SRL grants you a limited, non-exclusive, non-transferable, revocable license to access and use Trazet based on your selected subscription.
You must not:
- Reverse engineer, decompile, or tamper with Posizio or its underlying technology.
- Use the platform for unlawful surveillance or unauthorized tracking.
- Sell, lease, sublicense, or otherwise distribute access to the platform without express permission.
5. Data Privacy and Processing
By using Posizio, you agree that Futurkloud SRL may collect, store, and process data—including telemetry, geolocation, and device information—as outlined in our Privacy Policy.
You retain ownership of your data but grant Futurkloud SRL the right to use anonymized or aggregated data for analytics, product improvement, and compliance.
Trazet uses industry-standard encryption and safeguards, but no system is guaranteed to be 100% secure.
6. Subscription and Payment
Access to the platform is based on your selected subscription plan, which includes specific features, limits, and billing terms.
All fees are due as per the billing cycle and are non-refundable, unless stated otherwise.
Failure to pay may result in suspension or termination of your account.
7. Asset Monitoring and User Accountability
You must have the legal right to monitor or track any asset or individual using the platform.
You are solely responsible for how the platform and connected hardware are configured and used.
Futurkloud SRL assumes no liability for the misuse of tracking features or unauthorized access.
8. Intellectual Property
All intellectual property rights related to Posizio, including software, branding, and design, are the exclusive property of Futurkloud SRL or its licensors.
You may not copy, reproduce, or use the Trazet brand without written permission.
9. Platform Availability and Changes
While we aim for high availability, Posizio services may occasionally be disrupted due to maintenance, upgrades, or outages.
Futurkloud SRL reserves the right to change, enhance, or discontinue features at any time, with or without notice.
10. Termination
You may terminate your account at any time via the platform interface.
Futurkloud SRL may suspend or terminate your access if you violate these Terms, applicable laws, or abuse the platform.
11. Limitation of Liability
Posizio is provided “as is” and “as available”. Futurkloud SRL makes no warranties, express or implied, regarding uptime, accuracy, or fitness for a specific use.
Futurkloud SRL shall not be liable for any indirect, incidental, special, or consequential damages arising from your use or inability to use the platform.
12. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of the Italy, unless otherwise required by local law.
Any disputes arising from or related to these Terms will be resolved through binding arbitration or in a court of competent jurisdiction in Italy, unless otherwise mandated by applicable jurisdiction.
13. Modifications to Terms
- Futurkloud SRL may update these Terms periodically. You will be notified of any material changes, and continued use of the platform constitutes acceptance of the updated Terms.
